What Are OATH Violations?

OATH (Office of Administrative Trials and Hearings) is the NYC tribunal that adjudicates ECB (Environmental Control Board) violations issued by the Department of Buildings, FDNY, and other city agencies.

When an inspector issues an ECB violation, the property owner receives a notice to appear at an OATH hearing. At the hearing, they can pay the fine, contest the violation, or request an extension.

Failing to appear at an OATH hearing results in a default judgment — typically the maximum penalty — plus an additional surcharge.
