What Happens After an HPD Violation Is Issued?

Most owners don't find out until fines are already accruing. Here's the timeline.

1

Violation Issued

HPD inspector visits and documents the condition. A Notice of Violation (NOV) is recorded in the city system.

2

Cure Period Begins

Owner has 24 hours (Class C), 30 days (Class B), or 90 days (Class A) to correct the condition.

3

Re-Inspection

HPD may return to verify correction. If uncured, civil penalties begin accumulating — often per day.

4

OATH Hearing / Litigation

Uncured violations are referred to OATH tribunal or Housing Court. Fines can reach tens of thousands.

The average NYC landlord finds out about violations 14–30 days late — after fines have already started.

HPD Violation FAQs

How do I fix an HPD violation? +

Contact a licensed contractor to correct the condition, then file a Certificate of Correction (C of C) with HPD. For Class C violations you must also submit proof within the cure period or fines continue accruing.

Does an HPD violation affect my property value? +

Yes. Open violations appear in title searches and can delay or kill real estate transactions. Buyers and lenders routinely check HPD records before closing.

How long does an HPD violation stay on record? +

Violations remain on record indefinitely. Closed violations show as "corrected" but are still visible. This is why monitoring and quick correction matters.

Can tenants use HPD violations against landlords? +

Yes. Tenants can cite open violations in Housing Court rent withholding cases and harassment claims. Class C violations especially strengthen tenant legal positions.

How often does HPD update their violation database? +

HPD sends data to NYC Open Data daily. This tool queries that live dataset — so results are typically current within 24 hours of a violation being issued.

What is the difference between HPD and DOB violations? +

HPD (Housing Preservation & Development) handles tenant habitability issues — heat, pests, paint, plumbing. DOB (Department of Buildings) handles construction, permits, and structural code violations.
