What Are ECB Violations?

ECB (Environmental Control Board) violations are civil penalties issued by NYC agencies — primarily the Department of Buildings — for code violations that are then adjudicated through OATH (Office of Administrative Trials and Hearings) hearings.

Unlike DOB violations, ECB violations carry direct financial penalties. Property owners must either pay the fine or appear at an OATH hearing to contest it. Unpaid ECB fines become tax liens on the property.

What Happens After an ECB Violation Is Issued?

A DOB or agency inspector issues the ECB violation. It is recorded and a Notice of Violation mailed to the property owner.

OATH Hearing Scheduled

An OATH hearing date is assigned. Owner can pay the fine outright or appear to contest. Missing this date results in a default judgment.

Default or Decision

If no response: default penalty imposed. If contested: ALJ issues a decision. Either way the fine is now legally owed.

Tax Lien

Unpaid ECB fines become tax liens on the property. They accrue interest and can lead to foreclosure if left unresolved.

How do I pay an ECB violation? +

How long do ECB violations stay on record? +

Permanently. Paid/resolved violations show as closed but remain in the public record. This affects title searches, refinancing, and property sales.

What is the difference between an ECB and a DOB violation? +

A DOB violation is a notice requiring correction of a code issue. An ECB violation is a financial penalty that goes through the OATH tribunal process. Many DOB violations generate parallel ECB violations with fines attached.
